QALY Acceptable Use Policy

This Acceptable Use Policy describes the uses of our Services that are acceptable; and outlines prohibited uses and prohibited conduct in connection with our Services. Some terms (denoted by capitalised letters, for example “Services”) that are not already defined in this policy may have definitions set out in our Terms of Service.

We endeavour to allow our users to build their brands and grow their businesses. That process usually involves creating content and engagement experiences – and we encourage our users to be creative in that process. We also encourage (and expect) our users to use our Services responsibly and within the range of acceptable use defined herein.

Therefore, as a QALY user, you agree not to assist anyone to misuse the Services or to do so yourself.

QALY is a forward-thinking organisation and strongly believes in a positive future for the inhabitants of planet Earth. To that end, we wholeheartedly embrace International Law and the Universal Declaration of Human Rights. Such laws and such rights underpin our acceptable use policy (including our examples of what constitutes unacceptable use).

We have included below some guidelines regarding what constitutes unacceptable use – in other words these are things that you should not do with the Services.


A. Bringing QALY and/or the Service into Disrepute

A.1. You must not participate or encourage any activities that could result in the QALY company, QALY brand or the Services being brought into disrepute, or into a risk of illegal status or activity.


B. Disrupting The Services

B.1. You must not run experiments to reverse engineer, probe, scan, scrape or test the vulnerabilities of any part of the QALY Services including any part of the system, infrastructure and network.

B.2. You must not attempt to bypass, breach, hack or reverse engineer any part of the security or authentication mechanism of The Services. Note that it is prohibited to upload any type of virus or malware. Note that it is prohibited to knowingly causing overloading of any part of the infrastructure. It is only acceptable to use the security and authentication mechanism in the ways that are provided – which is the standard login, registration and other account support features provided in the QALY mobile app. We reserve the right to determine what is reasonable.

B.3. Note that it is also prohibited to knowingly causing overloading of any part of our third party providers’ infrastructure (including, without limitation, the APIs of the third party stock media libraries, push notifications, email providers and any other part of the third-party infrastructure). We reserve the right to determine what is reasonable.

B.4. You must not use any part of the system that are not specifically declared as part of the system that you are allowed to use. This also includes any administration area, domain registration aspects, secure certificate aspects, DNS aspects and any other aspect not specifically declared to be part of the services expected of you to use.

B.5. Do not share your password with anyone.

B.6. Do not use any other person’s user account (including, without limitation, username and password).

B.7. Do not share user credentials with others to manage your account and content.

B.8. Do not evade, avoid, bypass, delete, degrade, remove, deactivate, unencrypt or otherwise circumvent any measure (technological or otherwise – including watermarks) that QALY or any other user or third party have put in place to protect the Services.

B.9. Do not remove or modify any copyright or any other proprietary/legal notices from the Services.


C. Spamming, Phishing or other Potential Violations

C.1. Do not use our Services to send unsolicited communication that could violate CAN-SPAM or other laws. Do not send spam emails to those who have not explicitly consented to receive emails from you. We reserve the right to determine what constitutes spam and what constitutes unsolicited communication.

C.2. Do not send deceptive information (or engage in any deceptive activity) – including modified/altered or false source-identifying information. This includes, without limitation, any misleading or incorrect names, email addresses or misleading subject lines.


D. Deception and Impersonation

D.1. Do not undertake any activity that is false, fraudulent, inaccurate or deceptive/deceiving.

D.2. Do not impersonate any entity, organisation, company or individual.

D.3. Do not undertake any misleading, deceptive, illegal or unethical marketing or advertising

D.4. Do not advertise or promote products or services other than your on without express permission and/or authorisation.


E. Theft, Stealing and Illegal Activity

E.1. Do not use, or attempt to use, unauthorised credit cards, debit cards or other unauthorised methods of payment on the Services.

E.2. Do not undertake to sell the Services unless you are specifically authorised to do so.


F. Rights Violations, Rights Infringement and Misappropriation of Rights

F.1. Do not violate the copyright, trademark or other intellectual property rights and any individual or organisation.

F.2. Do not infringe the copyright, trademark or other intellectual property rights and any individual or organisation.

F.3. Do not misappropriate the copyright, trademark or other intellectual property rights and any individual or organisation.

F.4. Do not violate the privacy of an individual or organisation.

F.5. Do not violate the publicity rights of an individual or organisation.


G. Other Unacceptable Use, Improper Use or Illegal Conduct

G.1. Do not contravene the Universal Declaration of Human Rights.

G.2. Do not contravene International Law.

G.3. Do not incite violence.

G.4. Do not incite hatred.

G.5. Do not threaten, harass or abuse any individuals.

G.6. Do not publish sexually explicit or obscene material.

G.7. Do not condone or promote self-harm (in any form or to any level).

G.8. Do not condone or promote violence against any person, community or group based on race, ethnicity, nationality, religion, gender, gender identity, sexual preference, age or disability.

G.9. Do not violate any laws through the Services including, without limitation, all local, regional, state and national laws regarding online conduct and acceptable content.

G.10. We reserve the right to use our discretion to make conclusions about any misuse of the Services. If we conclude that you have breached our Acceptable Use Policy, we may take action against your Account and Your Resources – and this may include (but not necessarily be limited to) suspending content, removing content, suspending or terminating your Account and/or Your Resources, without any refund of any monies paid for the Services – and this would be without liability or notice to you – at any time and for any reason (except where prohibited by local law).

G.11. We reserve the right to enforce, or not enforce, this Acceptable Use Policy at our sole discretion.
